Welcome to PHOTELIER LLC! These Terms of Service apply to all of our services: our photo booth kiosks, this website (including digital downloads), and the PHOTELIER mobile app. By using any of them, you agree to be bound by the following terms. Please read them carefully.
For your ultimate privacy, our system is uniquely designed to automatically delete all photos, videos, and associated digital data from our cloud servers 24 hours after they are uploaded — normally right after your photo session. Section 2 of our Privacy Policy explains the copies kept on the booth itself during internet outages and for re-printing.
Disclaimer of Data Loss:You must download your digital media via the provided QR code within this 24-hour window. PHOTELIER LLC is not responsible for any lost, unrecovered, or expired media if you fail to download it in time. Once that window expires the cloud copy is deleted and we cannot restore it. (The booth keeps a copy of the printed sheet for up to 72 hours solely so staff can re-print it after a printing failure.)
While we strive for a seamless and reliable experience, occasional technical issues such as internet outages, hardware malfunctions, or low printing supplies may occur.
Maximum Liability:In the event of a machine error that prevents you from receiving your printed or digital photos, our maximum liability to you is strictly limited to a full refund of the amount paid for that specific session or purchase. PHOTELIER LLC shall not be liable for any indirect, incidental, special, or consequential damages.
Our photo booths are independently owned, operated, and maintained by PHOTELIER LLC and are simply placed in partner venues (such as cafes, restaurants, and retail shops).
No Liability for Host Venues:The owner, management, and staff of the host venue where the machine is located are not responsible for the operation, maintenance, refunds, or data management of the photo booth. By using the machine, you agree to hold the host venue completely harmless from any claims, disputes, or liabilities arising from your use of the photo booth. All support requests and refund claims must be directed exclusively to PHOTELIER LLC.
Our photo booths are located in public, family-friendly spaces. You agree not to use the photo booth for any illegal, obscene, sexually explicit, or highly offensive photography. Furthermore, any intentional vandalism, physical damage, or tampering with the machine’s hardware or software is strictly prohibited and will result in immediate legal action and claims for financial restitution.
The PHOTELIER mobile app requires an account and is available to users aged 13 and older. You agree to provide accurate registration information and to keep your sign-in credentials secure; you are responsible for activity that occurs under your account. We may suspend or terminate accounts that violate these Terms, abuse the service, or engage in fraudulent activity. You may delete your account at any time from within the app (see Section 8).
Through the app you can purchase photo sessions and custom frame designs, which are delivered as QR coupons redeemable at PHOTELIER photo booths.
The app allows you to post photo reviews (text, ratings, and photos) that are publicly visible to other users, and to upload background images for custom frames. By posting content, you grant PHOTELIER LLC a non-exclusive, royalty-free license to host and display that content within the service. You confirm that you own the content you post and that it does not infringe anyone else’s rights.
Zero Tolerance for Objectionable Content:Content that is illegal, sexually explicit, hateful, harassing, violent, spam, or that exposes another person’s private information is strictly prohibited — in reviews and in custom frame images alike. We may remove such content and suspend or terminate the offending account without notice.
Report & Block Tools:Every review can be reported from within the app, and you can block any user to immediately hide all of their content from your view. Content reported by multiple users is automatically hidden pending review, and we act on reports of objectionable content within 24 hours.
You may permanently delete your account at any time from inside the app (My Page → Delete Account). Deletion removes your profile, reviews, and unused coupons as described in our Privacy Policy; unused coupons are forfeited upon deletion, so please redeem or resolve them first. We may likewise terminate accounts that materially violate these Terms.
We may update these Terms from time to time as our services evolve. The “Last Updated” date at the top of this page reflects the most recent revision. Material changes will be announced through the app or this website, and continued use of the services after changes take effect constitutes acceptance of the revised Terms.
These Terms of Service and any disputes arising out of your use of the photo booth, mobile app, or our website shall be governed by and construed in accordance with the laws of the State of Texas. Any legal actions or proceedings must be resolved exclusively in the state or federal courts located in Harris County, Texas.
